The following obligations must be acknowledged by all 新区云 users, which have the same legal effect as official terms!
I. User Obligations
- It is forbidden to upload content prohibited by laws of Chinese Mainland, Hong Kong, United States, Singapore and other regions, including but not limited to political content, gambling-related content, illegal products, pornographic materials, pirated resources, infringing goods, counterfeit products, fraud platforms, movie resource sites, novel websites, lottery platforms and related content displayed via reverse proxy.
- VPS shall not be used to provide illegal proxy services similar to VPN. We reserve the right to provide relevant user information to competent authorities for investigation purposes once illegal activities are confirmed.
- Forbidden to launch network packet attacks, ARP spoofing, weak password scanning, run DHCP services, conduct malicious brute force attacks or interfere with normal operation of other servers.
- Forbidden to send spam emails, junk messages, spread trojans and viruses, or reference malicious files from external servers.
- It is prohibited to use or bind IP addresses that do not belong to your own VPS resources.
- Do not run high-resource-consuming programs such as traffic mining, virtual currency mining, video auto-running scripts, cluster computing and traffic brushing tools.
- Do not deploy websites or programs vulnerable to large-scale DDoS attacks, including private game servers, drug sales platforms, political sites and cheating tools.
- All improper network tests including active attack tests and pressure tests are prohibited on US anti-DDoS VPS.
- Users are not allowed to install extra operating systems or services based on official system templates, such as virtual Windows systems or soft routing services like RouteOS on Linux systems.
- 新区云 only provides direct official services without authorizing purchasing agents or third-party resale behavior. All related risks and consequences shall be borne by the direct purchaser.
- We reserve the right to process full refunds and terminate service access if users insult customer staff, make unreasonable troubles or refuse effective communication.
II. Resource Usage Rules
- Do not occupy excessive bandwidth for a long time by using peer-to-peer downloading tools and mining programs that affect overall network performance.
- Avoid long-term high disk I/O occupation caused by disk performance testing tools and heavy-duty security scanning software which may threaten server stability.
- Long-term high CPU usage caused by cluster computing and digital currency mining is strictly restricted.
- VPS bandwidth is peak bandwidth instead of exclusive dedicated bandwidth. Persistent full bandwidth occupation will lead to speed limit ranging from 20% to 50% of the original peak value.
- Long-term large-traffic pure proxy connections including node relay and multi-user proxy forwarding are not allowed.
- Anti-DDoS VPS is only designed for auxiliary traffic filtering. It shall never be used for active attack tests and malicious pressure measurement.
- When using overseas network resources for TikTok live streaming, cross-border e-commerce operation and other business activities, users shall take full legal responsibilities. We will cooperate with official investigations and provide relevant data when necessary.
III. Refund Policy & Non-refund Rules
- Unconditional account balance refund is available within 24 hours after VPS purchase. Original payment channel refund will deduct 10% handling fee with a minimum charge of 5 US dollars. No refund will be accepted beyond 24 hours without official service faults.
- All balance recharge and online device orders cannot be returned via original payment channels after 24 hours, even if the balance remains unused.
- Free route adjustment without extra fees and usage time deduction is supported within 1 day if users mistakenly select wrong network lines.
- Pre-deposit funds for agent accounts cannot be returned via original channels, only account balance refund is acceptable within 3 days.
- Each individual user is entitled to original channel refund service for only one time per month, and repeated applications may lead to permanent account ban.
- Refund applications will be rejected for malicious trial usage and any behavior violating user obligations mentioned above.
- No refund will be approved for accounts receiving spam complaints and improper usage reports regardless of active operation or external intrusion.
- An extra 10 US dollars service fee will be charged for refunds if users have reinstalled operating systems more than 5 times.
- IP accessibility inspection will be conducted before refund. Refund requests will be rejected if part or all assigned IP addresses are blocked in designated regions.
IV. Disclaimer & Data Loss Solution
- Service suspension and data loss caused by overdue payment, failure of timely renewal and voluntary refund application shall be borne solely by users.
- We are not liable for service abnormality and data loss resulting from improper user operation and misconfiguration.
- All consequences including service disconnection and data loss arising from content violation of user obligations shall be undertaken by users themselves.
- Normal service interruption caused by wars, armed conflicts, strikes, riots and other major social emergencies is beyond our liability scope.
- We shall not be held responsible for service failure and data loss caused by earthquakes, tsunamis, typhoons, floods and other irresistible natural disasters.
- Temporary connection failure of anti-DDoS VPS due to repeated large-scale attacks exceeding defense threshold is not classified as catastrophic failure. Service recovery depends on official data center unblocking progress.
- Our servers are not equipped with full disk redundancy and automatic data backup functions. Users are suggested to complete independent off-site data backup regularly. In case of confirmed catastrophic failures, annual subscribers will get 2 extra months of equivalent service duration while monthly subscribers will get 1 extra month compensation. No compensation for actual economic value loss of user data.
- In case of service upgrade and hardware replacement, we will try our best to assist data migration and issue advance notifications within 72 hours. We assume no obligations if users fail to receive notices due to incorrect reserved contact information.
V. Excluded Technical Support Scope
We currently do not provide comprehensive customized technical support services. Only faults related to physical host hardware and original VPS system abnormalities are included in free support. One-click panel installation and daily operation maintenance services are not covered, please understand.
VI. Violation Penalty Rules
- All accounts violating core user obligations will be locked until service expiration whether the violation is active or passive.
- Each VPS supports up to 5 free system reinstallations per month. Extra reinstallation service will charge 5 US dollars each time.
- VPS will be automatically suspended by the host server if single-core CPU usage remains above 70% or disk IO keeps high load status for over 2 hours. Repeated violations will lead to permanent account lock requiring manual negotiation for solution.
- VPS will be locked permanently once detected conducting port scanning and brute force attacks reported by data centers.
- High-consumption resource programs operation will result in system shutdown warning for the first time and permanent lock for repeated violations.
- Accounts involved in pirated content disputes and copyright complaints will be locked till expiration regardless of subjective intention.
- Spam-related complaints will lead to immediate account freeze with no exception.
- Any form of proxy service deployment including VPN-related services is completely banned, offenders will face permanent service ban.
- Unprotected VPS attacked by large-scale DDoS traffic will have IP isolated for 48 hours. Users are granted 2 hours for data backup before formal service termination.
- Anti-DDoS VPS triggering excessive long-term attack defense limits will be terminated after reserved data backup duration.
- Confirmed pressure test application behavior will cause definite service termination and account lock.
- Internal network attacks, ARP hijacking, unauthorized IP occupation and illegal DHCP deployment will all lead to full service lock till expiration.
*All locked accounts are allowed 1-2 hours of reserved data backup time before complete network disconnection. Locked resources will be automatically cleared upon expiration with zero refund guarantee.
VII. Fake Referral Restrictions
The following behaviors will be identified as same-person duplicate account registration. We reserve the right to reject commission withdrawal applications and cancel all related referral bindings.
- Continuous login records from identical public IP addresses.
- Frequent repeated usage of the same payment account information.
- Other valid evidence proving multiple accounts are controlled by one single user.
VIII. Service Operation & Traffic Supervision
Guaranteed overall service availability rate: 99%.
IX. Service Level Agreement (SLA)
We will conduct regular service data and traffic monitoring to optimize user experience and effectively restrain illegal VPN deployment and other non-compliant business behaviors.
